Zachary Page

Zach handles all aspects of complex commercial litigation, with a particular focus on both litigating intellectual property claims and helping clients to identify and protect their intellectual property rights. He regularly litigates disputes relating to trademark, copyright and patent infringement, rights of publicity, false advertising, misappropriation of trade secrets, breach of contract, regulatory compliance, internet domain name disputes, and unfair competition. Zach has experience with all stages of the litigation process, from the initial stages of the case through trial and appeal.

In addition to his litigation work, Zach regularly advises clients on strategies for identifying and protecting intellectual property rights, both in the United States and internationally. He also advises clients on regulatory compliance and labeling requirements.

While attending UCLA School of Law, where he was a managing editor of the UCLA Entertainment Law Review, Zach volunteered in the Legal Aid Foundation of Los Angeles’ (LAFLA) Self Help Center at the Santa Monica Courthouse, where he assisted defendants in family law proceedings and unlawful detainer actions. His pro bono work also includes volunteering for UCLA’s Landlord-Tenant Clinic.

Experience, Presentations and Publications

Representative Engagements
  • Represented personal care products manufacturer and retailers in action in Eastern District of California involving allegations of antitrust violations, patent infringement and trade dress infringement by competitor manufacturer. After hotly litigated activity in the pleadings and discovery stages, including several successful pleadings motions narrowing the issues for the case and over a dozen depositions, and working together with client’s key retailer, successfully moved for summary judgment of non-infringement and dismissal of antitrust claims.
  • Represented assignee of claims for right of publicity violations in action in Los Angeles County, through all stages of case from pleadings through trial and appeal. Developed creative resolution to address failure of would-be indemnitor to defend and indemnify defendant, including assignment of indemnity claims from defendant to client. Defeated indemnitor’s post-trial challenges, including motion to vacate the judgment and opposition to motion for attorney’s fees.
  • Represented consumer goods manufacturer in several actions in Central District of California concerning infringement of client’s trademarks and trade dress, including successful motion for preliminary injunction, motions for partial summary judgment, and pretrial preparations bringing case to the eve of trial resulting in settlement.
  • Obtained registration of a color mark for a major personal care brand after appealing USPTO’s rejection of its application. Also secured dismissal of oppositions filed by two competitors.
  • Represented employer in action in Alameda County to recover damages from embezzlement by former employee and former employee’s spouse, including claims for treble damages pursuant to Cal. Pen. Code § 496(c). Successfully pursued claims through removal to the Bankruptcy Court for the Northern District of California after defendant filed for bankruptcy. First chaired trial through a favorable judgment in adversary proceeding in the bankruptcy court, along with dischargeability of that liability. Obtained further enhanced damages, fees and costs through appeal.
  • Represented purchaser of life insurance policies in life settlement transactions in Central District of California involving claims for fraud in connection with the purchase and sale of those policies. Successfully litigated case through trial, resulting in favorable settlement during jury deliberations.
  • Represented a charitable organization in a false advertising class action. Obtained ruling denying class certification, resulting in dismissal of entire action.
  • Represented numerous clients in Uniform Domain Name Dispute Resolution Policy (UDRP) proceedings before the National Arbitration Forum and World Intellectual Property Organization, obtaining transfer of domain names that infringed client’s trademarks.
